Scope
These terms govern the clearance, decluttering, specialist cleaning, decontamination and repair work carried out by [TO BE COMPLETED] in Nice and along the Côte d’Azur.
They apply to private individuals and to professionals alike — notaires, court-appointed deputies, building managers, managing agents. Some provisions, marked as such, benefit consumers only.
Quote and acceptance
No work begins without a written quote that has been accepted. The quote is prepared after a visit, itemised line by line, and valid for thirty days.
The price is fixed. Anything not in the quote — a volume found in a cellar, drying made necessary by the state of the structure — is the subject of a written variation, accepted before it is carried out. Nothing is added afterwards.
Payment terms and any deposit: [TO BE COMPLETED]. Prices are quoted [excluding or including VAT: TO BE COMPLETED]; applicable VAT rate: [TO BE COMPLETED].
Written instruction — a precondition
Nothing is removed without a written instruction from someone entitled to give it: the owner, an entitled heir, a notaire, a court-appointed deputy, a curateur or a tuteur.
Where a property is jointly inherited, written agreement is required from every joint heir. Failing that, the visit and the quote can go ahead, but no removal is started.
This requirement is not negotiable. It protects the person instructing us as much as it protects the company.
What we will not do
We approach nobody unasked, in any form.
We buy no contents and make no offers to buy. We give no valuations: a company that clears a property cannot buy what it is clearing without a conflict of interest. For any question of value, speak to a commissaire-priseur — a licensed French auctioneer — and we will wait for their visit at no change to the quote.
We throw away no personal effects by default.
Personal effects and documents
Administrative documents, photographs, letters, jewellery and anything of a personal nature are set aside on the first day, photographed, listed and stored separately.
They are handed to the person instructing us or to someone they name, or shipped by insured courier. Shipping appears as a separate line on the quote.
If something is found after the work has finished, it is kept and reported.
Timing
The durations given in the quote are estimates made after the visit. They can vary with the actual volume, the state of the property, the granting of a parking permit by the city, or a building manager’s agreement to give access.
Any change to the schedule is reported without delay. A report is sent at the end of each working day, with dated photographs.
Waste and traceability
Everything removed goes to licensed disposal channels, sorted beforehand. Transfer notes are issued in the agreed name — the client’s, the joint heirs’ or the notaire’s office — and handed over at the end of the job.
Hazardous waste, household chemicals and specific materials follow separate channels and are never mixed with bulk waste.
Insurance and liability
The company holds professional liability insurance; the certificate is attached to the quote.
The company is not liable for pre-existing defects recorded and documented in the initial survey, nor for the consequences of inaccurate information given by the person instructing us — in particular as to their standing to instruct, or the existence of other entitled parties.
Right of withdrawal — consumers
Where the contract is concluded away from business premises, a consumer has fourteen days to withdraw without giving a reason, under articles L221-18 and following of the French consumer code. A withdrawal form is attached to the quote.
If you want the work to start before that period ends, we take your express request in writing. You then remain liable for whatever has been carried out by the date of withdrawal.
This right does not apply to professionals or to anyone instructing us in the course of their business.
Complaints
Complaints should be sent in writing to [TO BE COMPLETED]. We acknowledge receipt within eight days and answer substantively within one month.
Failing an amicable settlement, a consumer may refer the matter free of charge to the consumer mediator named in the legal notice.
Governing law
These terms are governed by French law. Where the French, English and Italian versions differ, the French version prevails.
